Service Contract

This Levin Service Co. Platinum Protection Plan (this plan or service contract) is a service contract between (YOU, YOUR), and Levin Furniture & Mattress, the seller of this service contract (WE, US, OUR). This plan is not insurance, nor is it your original manufacturer’s warranty. This plan only applies to new fabric, leather, and vinyl upholstered furniture; wood and other hard surface furniture and adjustable bases; up to a maximum of $20,000 in retail value, used in a normal household setting.

This plan applies to the furniture as identified on the sales ticket attached to this service contract for which a service contract has been purchased. The price of this service contract is listed on the attached sales ticket.

This plan is the complete and exclusive statement of the terms and conditions regarding our performance of service, and replaces any prior oral or written communications on that subject.

This plan is only valid in those markets which Levin Furniture & Mattress operates.

If at the end of 5 years you have not made a claim on your service contract, we will email a Levin Furniture certificate valid for 180 days equal to the value of the service plan, excluding sales tax.

Coverage Period

This plan is valid for a period of five years from the date of delivery of your new furniture covered by this plan (the “term”).

  • What This Agreement Covers

    In exchange for your purchase of this plan, we agree to provide five years of in-home cleaning, protection, and repair service through one of our authorized service technicians for the following "covered" occurrences of accidental damage:

    Fabric, Leather, and Vinyl

    • Food and beverage stains

    • Cosmetics and lotion

    • Nail polish/remover

    • Bleach

    • Glue, tar, wax, and gum

    • Grease/motor oil

    • Paint or crayon

    • Ink, marker, or dye

    • Grass and mud stains

    • Rips and punctures*

    • Cuts

    • Burns

    • Failure of integral electrical components

    • Human and animal bodily fluid stains

    • In-home labor

    Wood

    • Food and beverage stains

    • Cosmetics and lotion

    • Nail polish/remover

    • Bleach

    • Glue, tar, wax, and gum

    • Grease/motor oil

    • Paint or crayon

    • Ink, marker, or dye

    • Grass and mud stains

    • Burns

    • Gouges or chips that penetrate the finish exposing the substrate

    • Checking, cracking bubbling, or peeling of finish caused by a specific incident

    • Breakage, chips, or scratches of glass or mirrors

    • Failure of integral electrical components

    • Human and animal bodily fluid stains

    • In-home labor

    Adjustable Base (Reimbursement Plan)

    • Failure of integral electrical components

    Outdoor Furniture

    • Food and beverage stains

    • Cosmetics and lotion

    • Nail polish/remover

    • Bleach

    • Glue, tar, wax, and gum

    • Grease/motor oil

    • Paint or crayon

    • Ink, marker, or dye

    • Grass and mud stains

    • Rips and punctures*

    • Cuts

    • Burns

    • Breakage, chips, or scratches of glass or mirrors

    • Human and animal bodily fluid stains

    • In-home labor



    We also agree to provide service for the following specific manufacturer structural warranty coverages for the five year term of this plan, but only after the original manufacturer structural warranty has expired:

    Fabric, Leather, and Vinyl

    • Sleeper mechanism

    • Reclining mechanisms

    • Inclining mechanisms

    • Handles, heating, vibrating mechanisms, and remote control

    • Power supply

    • Handles, heating, vibrating mechanisms, and remote control

    • Power supply

    Adjustable Base (Reimbursement Plan)

    • In-home labor

    • Wood frame or structure

    Outdoor Furniture

    • In-home labor

    • Wood frame or structure

    • Umbrella mechanism

  • What This Agreement DOES NOT Cover

    • Stains or damages other than those specifically listed in the section of this plan labeled “What This Agreement Covers”.

    • Where you were not issued a receipt reflecting your purchase of this plan.

    • Any loss covered under any homeowners or other insurance policy you maintain.

    • Stains or damage occurring prior to or during delivery or while the furniture is in or being moved into or out of storage or being moved from one residence to another.

    • Damage caused by scratches on any surface except glass.

    • Stains or damage, including color loss, caused by cleaning methods other than those recommended by the furniture manufacturer.

    • Stains or damage caused by, or the result of, mold or mildew.

    • Stains or damage caused by independent contractors such as, but not limited to, maintenance personnel, painters, or other repair or contractor services.

    • Damage caused by animal beaks, teeth, or claws.

    • Damage caused by fire, smoke, flood or other natural disasters, theft or vandalism.

    • Damage caused by structural problems or appliance malfunctions such as, but not limited to, leaks from air conditioners, sky lights, roofs, water heaters, or water pipes.

    • Furniture that is used for commercial, industrial or rental purposes.

    • Furniture that has been mishandled, neglected, abused, or misused.

    • Furniture sold “as is” or floor samples; unless noted on sales order.

    • Stains or damage caused by normal soiling from everyday use or a stain or soil buildup over time including body, hair, or suntan oils (signs of soiling include, but are not limited to, darkened areas where the head, arms, and legs come in contact with the upholstery). This plan does not provide for overall cleaning. General maintenance including regular professional cleaning of the furniture is your responsibility.

    • Damage caused by wear such as, but not limited to fading, seam separation**, stress tears***, or loss of foam resiliency on all types of furniture; pilling or fraying of fabric; color loss or cracking and peeling of leather or vinyl.

    • “X” Cleaning Code fabrics and Non-Colorfast Fabrics and leathers.

    • Natural leather markings such as, but not limited to, scars, insect bites, brand marks, and wrinkles.

    • Odors.

    • Furniture showing signs of infestation, including but not limited to insects, rodents, termites, and cockroaches.

    • Pre-existing conditions.

    • Replacement furniture we provide to you is not covered by this plan.

    • Any stain, rip, or burn totaling more than 6 inches in length are considered preventable and will not be covered.

    • Outdoor plan does not cover unraveling or fraying of wicker furniture as this is not a single relatable occurrence. Wind damage to umbrellas is not covered. Rust is not covered.

    • Unknown stains (are not covered).


    DEFINITIONS

    *Rip:  Tear that clearly penetrates through the upholstered material.

    **Seam Separation:  An upholstery seam that comes unstitched or unglued.

    ***Stress Tear:  Tearing or ripping of upholstery within a 1/2 inch of, and parallel to, the seam line.

Instructions for Care

IF YOU SHOULD SPILL A SUBSTANCE ON YOUR FURNITURE  ITEM, PLEASE FOLLOW THE INSTRUCTIONS BELOW:

Immediately blot up liquid spills with a dry or lightly dampened (but never wet) clean white cloth, sponge or paper towel. To blot, simply place the clean white cloth, sponge or paper towel directly on top of the spill applying light pressure to absorb as much of the liquid as possible. Be careful to not damage the fabric by rubbing. Do not use any cleaning agents prior to calling us to avoid voiding your contract.

How To Make A Claim

If a stain or damage occurs to your furniture call 844-600-1795 to file a service claim during the hours of Monday-Friday 9a-6p and Saturday 9a-4p EST. If you are experiencing structural issues with your adjustable base, follow the steps in #7 below.

FAILURE TO MEET ANY OF THE FOLLOWING REQUIREMENTS CAN RESULT IN A DENIAL OF SERVICE UNDER THIS PLAN.

  1. Claims will be assessed via photographs and/or an authorized technician.

  2. If your claim is approved, the authorized technician may remove the stain or repair the damaged area, we will, at our option, either recover or replace the stained or damaged area. Replacement of a part ends this plan’s coverage of that part, (for example, if we replace a seat cushion casing, we will not service or replace that seat cushion again). We may use original or non-original parts or substitutions at our sole discretion. Due to variations in dye lots, we cannot guarantee an exact color match. If the color match is not acceptable to you, you may choose to receive a refund of the purchase price of your plan and the plan will terminate.

  3. If a repair is not possible, we will replace the stained or damaged piece of furniture. We are only responsible for replacing the stained or damaged piece.

  4. If a repair is not possible and we have elected to replace the stained or damaged furniture and the original item is no longer available, we will allow you to select a new piece of furniture up to the original purchase price of the stained or damaged piece of furniture. Replacement of an item ends the plans coverage on that
    item. Other pieces covered by this plan but not replaced remain covered for the remaining term of the plan.

  5. Your stained or damaged furniture is the property of Levin Furniture and at our discretion will be picked up when your new furniture is delivered. Failure to surrender your damaged furniture at the time of delivery of the replacement furniture will stop delivery of your replacement
    furniture and result in the forfeiture of all your rights regarding that furniture under this plan.

  6. Replacement furniture we provide to you is not covered by this plan.

  7. Adjustable Bases: to make a claim for your covered adjustable base, you must first contact the Manufacturer for service assistance. The 800# for each manufacturer can be found on the back of your remote. It is the customer's responsibility to pay for any parts or labor within the warranty period and submit the paid invoice to warrantyclaims@levinfurniture.com for reimbursement.

General Terms and Definitions

A.  Cancellation:  You may cancel this plan for any reason by sending a written notice including the plan and a copy of your invoice to:

If you cancel within ten (10) calendar days of the purchase date on your sales ticket, you will receive a full refund less the cost of any service provided or claims paid. We may cancel this agreement for fraud, material misrepresentation, or non-payment by you or if required to do so by any regulatory authority. Notice of such cancellation will be in writing at least fifteen (15) calendar days prior to cancellation. If we cancel, your refund will be based upon 100% of the unearned pro rata premium.

B. Transferability:  This service contract is non-transferable.

C. Obligations of the provider under this service contract are backed by the full faith and credit of the provider. The provider may be contacted as follows:

Limited Services Warranty; Disclaimer of Warranties

We warrant only that the services will be performed in a professional and skillful manner. No other express warranties are provided to you. Any implied warranties are limited to the term of this service agreement. No other information or advice (written or oral) provided to you by us, our employees or our contractors, will create a warranty by us or increase the scope of this agreement. This plan gives you specific legal rights, and you may also have other rights that vary from state-to-state. Some states do not allow limitation on how long an implied warranty lasts, so the above limitation may not apply to you.

Limitation of Liabilities

Our limit of liability for any claim under this service contract is the cost to repair your covered product in accordance with the terms of this service contract, not to exceed the retail purchase price of the covered product. Please note, under no circumstances are we liable for any special, incidental, indirect, or consequential damages, even if we are informed of their possibility. Some jurisdictions do now allow the exclusion or limitation of such damages, so the above exclusion or limitation may not apply to you.
